2.0 Aims and Objects: The aims and objects of the club shall be;
2.1 To promote social life by providing a common place and facilities for the members to meet and foster the spirit of goodwill and fellowship.
2.2 To promote Arts, Science, Games, Sports, and other cultural Activites.
2.3 To render social, charitable and humanitarian works.
2.4 To undertake such other lawful activites as are incidental or conducive to the realisation of the above objectives.
3.0 Definitions :- In the constitution unless the context otherwise requires:-
3.1 “The Club” means The Presidency Club, Kidangoor, Kidangoor P.O. 683 572, Angamaly
3.2 “ Constitution” means, the Constitution of the Club - Part I of this document.
3.3 “Bye-laws” means the Bye-laws of the club - Part II of this document.
3.4 “ Managing Committee” means, the Committee constituted under clause II of this Constitution.
3.5 “ Affiliated Club” means, the Club with which the club has,reciprocal arrangements. The Presidency Club Constitution and Bye-Laws 2
3.6 “ Affiliated Member” means, the member of an affiliated Club.
3.7 a) ‘Member’ means any member of the Club enrolled as per provisions vide clause no. 5 of the constitution and in the case of institutional member, the nominees. b) ‘Family’ Means member, Spouse and dependent children (married Children not coming under the purview of family)
3.8 “Membership Committee” means, a sub-committee consisting Secretary, and 5 members nominated by the Managing Committee as much as possible from among the past Presidents, past Vice presidents, past Secretaries and past Treasurers of the Club.
3.9 “Notice Board” means, the notice board of the Club.
3.10 “Standing” denotes number of completed club year that a person has been a member of the club. The standing of member’s spouse shall be reckoned as the standing of the member for all purposes.
3.11 “Club Year” means, the accounting year from 1st January to 31st December every year.
3.12 “ Disciplinary Committee” means as sub Committee of minimum 3 members constituted from the past Executive officers of the Club.
Presidency Club is a family club and hence membership shall ordinarily be limited to married people (spouse alive) with good character and social acceptability. In exceptional cases, membership may be extended to single persons.
4.2 Power of Admission The power of approving membership applications and enrolling member to the club shall be vested with the Mg. Committee, after considering the recommendation of Membership development Committee wherever necessary. The Presidency Club Constitution and Bye-Laws 3
4.3.1 The membership fee for all categories of membership will be decided by the Mg. Committee from time to time.
4.3.2 Mg. Committee is also authorised to take decision on fixing subscriptions, extra charges for additional members from the family for using club facilities/premises, registration fee for club functions, cost of canteen services etc. from time to time.
4.4 Procedure of admission
4.4. 1 Only founder/life/Institutional member (or their spouse) can propose persons/institutions for admission in any category of membership. Any such proposal to be seconded by at least 3 Founder/Life member/Institutional member (or their spouse) shall be submitted to the Secretary in writing in the prescribed form.
4.4.2 In the case of Founder/Life and Ordinary membership, the Secretary will exhibit the proposed names in the notice board Any Founder / Life member / Institutional member ( or their spouses) having objections if any shall intimate in writing to the Secretary within 10 days of the publication of the proposal. The Secretary shall place the proposal along with objections if any before the Membership committee., The membership committee after examining the same and further enquiry if requied will place their recommendation to the Mg. Committee for approval. The Managing committee shall take final decision to accept/ reject the proposals.
4.4.2.1 For approved proposal Secretary will invite the person to the membership brief him the activites of the club and collect the admission fee required. After paying the full amount only he will be recognized as member. However, on payment of advance (as approved) the person will be provisionally allowed to use the facilities of the club premises. The full paymet shall be made within three months time. The Presidency Club Constitution and Bye-Laws 4
4.4.2.2.In case the full payment not received in the prescribed time the Managing Committee at their discretion may extend the period for additional 3 months. In cases still payment not made fully, membership shall be terminated without further notice and the advance paid will not be refunded at any cost.
4.42.3 If the membership proposal is rejected the same will be intimated to the first propose.
4.4.3 Proposal for Institutional membership, honorary membership and Visitor membership will be examined by the Mg. Committee and appropriate decision will be taken.
4.5.1 Each member will be alloted with a membership number. Membership number will be given only after paying the full amount of admission fee.
4.6.1 The Founder/Life members along will be given Identity Card (Non transferable) in due course. The Identity Card is a club property and to be surrendered when called for. Identity card for the Insitutional members will be at the discretion of the Mg. Committee from time to time.
4.7 Membership transfer
4.7.1 Among all the categories of membership. Founder memebrship alone has the privilege of tranferring the membership to either their spouse or one of the children with all the privileges of the original founder member. Transfer is subject to the conditions and procedure as per clause 4.8 and 14.3.9 of constitution
4.8 Procedure for transferring Founder Membership; Founder Membership is transferable to the nominee who shall be spouse or one of the children in case of death/Total incapacitation physically or mentally. If eligible the membership will ne transferred to the nominee without any additional payment against membership fee. The Presidency Club Constitution and Bye-Laws 5
4.8.1 The successor nomination can be done at the time of joining or therafter.
4.8.2 In the absence of any such nominations the spouse automatically become the Founder member or the spouse can nominate any one from their children for membership.
4.8.3 If the spouse is not alive the children above 18 years shall nominate one amoug the children for the membership.
4.8.4 In case all the children are below 18 years, they will be permitted to use the club facility. The membership will be conferred to the first male child on attaining 18 Years. If no male child then to the first girl child on attaining 18 years. On attaining 18 years only voting power will be given.
4.8.5 In case where children get nominated for the membership the membership procedure will follow and Mg. Committee reserves the right to accept/reject any nominations. If approved he/she shall be admitted in the role of Founder member with all the privileges of original Founder member. If the managing Committee rejects the nomination they can nominate another one from the children. If none of the children gets approved the membership will get automatically terminated and if so not eligible for any refund against the membership fee/ subscribtion paid.
4.8.6 Whether nominations exists or not within six months time after the death/incapacitations the club should send communication regarding membership transfer to the address available with copy displayed in the notice board.
4.8.7 Any claim on membership to be claimed within 12 months of this letter. If no claim is made in 12 months time the membership will get automatically terminated.
5.3.1 A company, firm or a business establishment who have joined the club by subscribing the institution membership fee prevailing at the time of joining. An institutional member with the approval of the Mg. Committee shall be entitled to nominate two of its senior executives/partners/proprietors/directors to enjoy all the rights/privilages of the club at par with the life member.
5.4.1 Ordinary members are those admitted to the club by Subscribing the ordinary memebrship fees prevailing at the time of joining. Ordinary membership is given to a specific period of 1 year extendable at the discretion of the Managing Committee. Ordinary membership will be given primarily to non-resident professionals / Executives/Officers/ NRI etc. Ordinary members have neither voting power in the general body nor they can hold any position in the Mg. Honorary membership may be conferred on eminent persons so recognized by the Managing Committee for a specified period of time without collecting any admission fee. Honorary members have neither voting power nor they can hold any position in the Mg. Committee.
5.6 Visitor members Visitor members are admitted to the club by subscribing to the visitor membership fee prevailing at the time of joining. Visitor membership is given primary to professional/Executives/Officers on deputation, NRI etc. for period of 3 months, extension for an additional term at the discretion of Mg. Committee. Visitor members have neither voting power in the general body nor they can hold any positions in the Mg. Committee.
6.1 Utilising the club facility Subject to the provisions of the constitution and Byelaws and the directions of the Mg. Committee, members and their families shall be entitled to use premises and facility of the club, on payment of fee if any. Mg. Committee reserve the right to fix/refix any fee for utilizing the club facility. Non-dependent family members may be admitted only during special occasions by paying the fee prescribed by the Mg. Committee. Every member visiting the club should enter his/her name in the prescribed register kept for the purpose.
6.2 Successor nomination Only Founder members has the privilege of nominating his/her spouse or one of the children as his/her successor for transferring the membership as a Founder member as per the provision in 4.7 & 4.8
7.1 All subscriptions/fee bills shall become due for payment on the first day of the succeeding month. If the dues are not paid in full within a calender month, interest at the rate of 2% per months shall be charged The Presidency Club Constitution and Bye-Laws 8 on the outstanding from the due date. The maximum amount of credit allowable for a member shall be decided by the Managing Committee.
7.2 Ordinary members and visiting mebers will not be allowed any credit from the club
8.1 If dues are not paid by any individual member or the nominees in the case of an Institutional member within 2 calender months the due date, the credit facility shall stand withdrawn, without any intimation. The Secretary shall send a formal letter to the defaulting member by registered post, acknowledgment due, asking him to settle his dues in full within 15 days of receipt of the notice. If the dues are not settled with in this period the membership shall be terminated after giving chance to hear him.
9.1 Dependent children of member shall, on the responsibility of the members, have access to the Club premises, Library, games and sports facilities.
9.2 Non dependent sons and daughters and their spouses and children shall be allowed on the responsibility of members to enjoy the club facilities on special occasions on payment of fee fixed by the Mg. Committee.
10.1 Members are not permitted to entertain guests. Persons within close family only will be allowed on special occasions/club functions as decided by the Mg. Committee from time to time.
11.1 The management of the club for the first 3 years here of is vested with a committee called First Managing Committee, elected by 24 people (appendix-1) among founder members who have subscribed their signatures to this constitution and byelaws on 2nd January 1995. The The Presidency Club Constitution and Bye-Laws 9 ensuring members shall not challenge the decisions of this Committee or demand dissolution of this Committee or reconstitution during the tenure of 3 years. This committee will consist of a President, a Vice President, a Secretary, a Joint Secretary, a Treasurer and 13 members whose names are described as appendix-II of this Constitution.
11.2 Without prejudice to the provisions of clause 11.1 above, for the following years the Management of the club shall be vested with a Managing committee consisting of President, Vice President, Secretary, Joint Secretary, Treasurer and 10 members, elected every year at the Election General Body Meeting, in the manner prescribed by the byelaws, provided that President, Secretary, and Treasurer of the previous year committee shall be members of the committee for the sake of continuity and that not less than 2 of the members shall be ladies from members/spouses. The Managing Committee is responsibile for the raising & collection of funds, acquisition, disposal of land, construction of buildings and making arrangements for other facilities as they deem fit for the operation of the club.
11.2.1 The minimum standing required to contest/ be elected as, President, Vice President, Secretary, Joint Secretary, Treasurer shall be two years and the candidates shall have served in the Mg. Committee at least for a period of minimum 6 months in any capacity.
11.2.2 Members eligible to vote in General Meeting alone shall be eligible to serve on the Mg. Committee.
11.2.3 No member shall hold the office of the President, Secretary or Treasurer for more than 2 consecutive terms.
11.2.4 A vacancy arising in the Mg. Committee shall be filled up by the Mg. Committee by co-option, provided that a vacancy in a particular category of membership shall be filled up from that category of persons only.
11.2.5 The Mg. Committe shall have the power to invite experts to the Committee if thay deem necessary, but this invites shall have no power to vote. The Presidency Club Constitution and Bye-Laws 10
11.2.6 The Managing Committee may unanimously nominate commonly acceptable members irrespective of their eligibility as provided under clause 11.2.1 to one or more offices. Such nomination shall be presented for approval of the General Body specially convened for the purpose.
11.2.7 Any member of the Mg. Committee whether elected or co-opted shall cease to be a Committee Member; under the following conditions:
a) He/She resigns from the Mg. Committee and the resignations is accepted.
b) He/She fails to attend 3 consecutive meeting of the Managing committee without leave.
11.2.8 Every member of the Mg. Committee shall keep confidential all the matters that are discussed in the committee meeting and the decision taken by the committee. The matters to be communicated to the members or any other person shall be communicated by the Secretary/president any records such as Minutes etc of the club, copies should be available to members on request.
11.2.9 Any member desirous of getting copy of Mg. Committee minutes/record may do so in writing to the Secretary and the Secretary to provide the copy in 3-4 days time. If required Secretary may seek the opinion of the Mg. Committee.
